Terms & Conditions

Article 1 – Identity of the Company

Dulguun Otgonjav Interior Architect is a sole proprietorship based in Sint-Katelijne-Waver, Belgium.

Legal form: Sole proprietorship
Registered office: Sint-Katelijne-Waver, Belgium
These general terms and conditions apply to all services, quotations, agreements, and invoices issued by Dulguun Otgonjav Interior Architect.
If the business is converted into a private limited company (BV) in the future, these terms and conditions will remain applicable unless explicitly stated otherwise.

Article 2 – Applicability

These general terms and conditions apply to all offers, quotations, agreements, and services provided by Dulguun Otgonjav Interior Architect.
By accepting a quotation, signing an agreement, or paying a deposit, the client acknowledges that they have read and accepted these terms and conditions.
Any deviations from these terms shall only be valid if explicitly agreed upon in writing.
Any general terms and conditions of the client shall not apply unless expressly accepted in writing by Dulguun Otgonjav Interior Architect.

Article 3 – Description of Services

Dulguun Otgonjav Interior Architect may provide, among others, the following services:

  • interior design and concept development

  • preparation of plans and visualizations

  • material and color consulting

  • custom furniture design

  • guidance of interior projects

  • site supervision

  • project management

  • advice regarding layout, furnishing, and finishing

The interior architect acts solely as a designer, advisor, and project guide.
The execution of construction or renovation works is carried out by external contractors or suppliers.

Article 4 – Nature of the Obligation

The services provided by Dulguun Otgonjav Interior Architect constitute a best-efforts obligation.
The interior architect undertakes to perform the assignment with due care and professionalism, in accordance with the rules of the profession and taking into account the wishes of the client and applicable technical standards.
No guarantee of a specific result is provided.

Article 5 – Quotations and Formation of the Agreement

All quotations are non-binding and valid for 30 days, unless otherwise stated.
An agreement is considered concluded when:

  • the client accepts the quotation in writing, or

  • a deposit payment has been made.

Changes to the original assignment, design, or scope of the project may result in an adjustment of the fee and planning.
Additional work will be invoiced separately.

Article 6 – Fees and Pricing Structure

The fees of Dulguun Otgonjav Interior Architect may be calculated based on:

  • a fixed price per phase

  • an hourly rate

  • a percentage of the total project budget

  • a combination of the above methods.

All prices are expressed in euros and exclude VAT, unless otherwise stated.
Additional costs such as, but not limited to:

  • travel expenses

  • printing costs

  • models or prototypes

  • 3D visualizations

  • external studies or consultancy

may be charged separately.

Article 7 – Payment Terms

The fees of Dulguun Otgonjav Interior Architect may be calculated based on:

  • a fixed price per phase

  • an hourly rate

  • a percentage of the total project budget

  • a combination of the above methods.

All prices are expressed in euros and exclude VAT, unless otherwise stated.
Additional costs such as, but not limited to:

  • travel expenses

  • printing costs

  • models or prototypes

  • 3D visualizations

  • external studies or consultancy

may be charged separately.

Article 8 – Obligations of the Client

The client undertakes to:

  • provide all relevant information and documentation in a timely manner

  • clearly communicate the available project budget

  • make decisions within a reasonable timeframe

  • provide necessary access to the project site

  • pay invoices on time

  • contract and pay contractors and suppliers directly.

Delays caused by late decisions or missing information may result in adjustments to the planning and additional costs.

Article 9 – Contractors and Suppliers

The interior architect may recommend contractors or suppliers, but the client remains entirely free to select the executing parties.
Contracts for the execution of works are concluded directly between the client and the contractor or supplier.
Dulguun Otgonjav Interior Architect cannot be held liable for:

  • errors in the execution of works

  • delivery delays

  • price changes

  • defects caused by contractors or suppliers.

Article 10 – Planning and Execution

Any timelines for execution are indicative only.
The interior architect cannot be held responsible for delays caused by:

  • contractors or suppliers

  • design changes

  • late decisions by the client

  • delivery issues

  • force majeure or unforeseen circumstances.

Article 11 – Site Supervision and Project Management

If the assignment includes site supervision or project management, this task consists of coordinating and guiding the works.
The interior architect does not perform construction works and is not responsible for the technical execution carried out by contractors.
Any comments or recommendations made by the interior architect are advisory in nature.

Article 12 – Liability

Dulguun Otgonjav Interior Architect may only be held liable for direct damage resulting from a proven fault in the execution of the assignment.
Liability is in any case limited to the amount covered by the professional liability insurance.
The interior architect cannot be held liable for:

  • errors or negligence of contractors or suppliers

  • indirect or consequential damages

  • damages resulting from incorrect information provided by the client.

Article 13 – Intellectual Property

All designs, plans, drawings, visualizations, and concepts remain the exclusive intellectual property of Dulguun Otgonjav Interior Architect.
The client is granted the right to use these documents solely for the specific project for which they were created.
Copying, distributing, or reusing the designs without the written consent of the interior architect is not permitted.

Article 14 – Use of Visual Material

Dulguun Otgonjav Interior Architect reserves the right to use photographs and visual material of completed projects for:

  • portfolio purposes

  • website

  • social media

  • publications

unless the client explicitly objects in writing.
Personal data or identifiable private information will not be disclosed.

Article 15 – Termination of the Assignment

If the client terminates the assignment prematurely, Dulguun Otgonjav Interior Architect is entitled to:

  • payment for work already completed

  • reimbursement of incurred expenses

  • reasonable compensation for services already performed.

Article 16 – Force Majeure

In the event of force majeure, Dulguun Otgonjav Interior Architect cannot be held liable for the failure or delay in fulfilling obligations.
Force majeure includes, but is not limited to:

  • illness

  • pandemics

  • fire

  • strikes

  • supply chain disruptions

  • government measures.

Article 17 – Privacy and Data Processing

Personal data of the client will be processed in accordance with applicable privacy legislation (GDPR).
Such data will only be used for:

  • execution of the agreement

  • invoicing and administration

  • communication related to the project.

Article 18 – Applicable Law and Jurisdiction

All agreements with Dulguun Otgonjav Interior Architect are governed by Belgian law.
Any disputes shall fall under the jurisdiction of the courts of the judicial district in which the company is established.
